“When the Sea Closes: From Maritime Blockades to Investment Treaty Arbitration.”
The article explores one of today’s most significant yet often overlooked legal consequences of geopolitical crises: the growing impact of maritime blockades, sanctions and armed conflicts on foreign investment protection.
As global trade routes become increasingly exposed to geopolitical tensions—including disruptions affecting strategically important maritime corridors such as the Strait of Hormuz—investors face rising legal uncertainty regarding the protection of assets, contractual rights and long-term investments.
Drawing on international investment law and recent treaty practice, Anastasia examines how investment treaty arbitration may provide legal remedies when foreign investments suffer substantial losses due to state actions or conflict-related disruptions. The article discusses key legal concepts including expropriation, fair and equitable treatment, full protection and security, and evolving standards applied by arbitral tribunals.
